Article 1 (Purpose)

These Terms of Use ("Terms") apply to users of the field recording studio "SKYSQUARE" (the "Facility") operated by AZSTOKE Inc. (the "Company"). Users shall use the Facility upon agreeing to these Terms.


Article 2 (Consent to Publication of Production Credits)

  1. As the Facility is operated for the purpose of advancing sound-production techniques and exploring production methods, publication of the user's company name (trade name) as part of the Facility's production track record is a mandatory condition of use. When a user makes a reservation to use the Facility, the user is deemed to have consented to the Company publishing said credit (company name) on its website, in IR materials, and the like.

  2. Notwithstanding the preceding paragraph, publication of the title and detailed production content of projects produced using the Facility is optional. While the Company encourages active disclosure for the development of the industry, users may keep these confidential in accordance with their own PR strategy or confidentiality policies.


Article 3 (Conditions of Use and Reservations)

  1. To maintain the quality of the Facility and ensure the expertise of setups, reservations are accepted in principle for five (5) hours or longer. Short recording sessions of less than five hours are not accepted.

  2. For safety management and equipment operation, three (3) Company staff members shall always accompany and attend any use of the Facility.


Article 4 (What Is Included in Facility Use)

The Facility usage fee includes the following items:

(1) Use of the land in all areas of SKYSQUARE

(2) Use of electricity and internet

(3) Use of Company-owned microphones, recorders, and PCs (users may also bring their own)

(4) Use of radios and intercoms

(5) Use of foley materials

(6) Use of power tools (subject to Article 5)


Article 5 (Specialized Work and Qualifications)

Work requiring statutory qualifications — such as heavy machinery operation, slinging, chainsaw operation, and welding — shall be performed only by Company staff holding the relevant qualifications, and users may not perform such work themselves.


Article 6 (Recorded Deliverables and Fee Settlement)

  1. Due to the nature of an outdoor field, the number of recordings and the content of deliverables may increase or decrease due to environmental factors such as weather, traffic conditions, and wildlife sounds (e.g., bird calls); the Company makes no guarantee in this regard.

  2. Even if the number of deliverables falls below expectations, the usage fee will not be reduced. Likewise, even if deliverables exceed expectations, no additional fee will be charged.

  3. As Facility usage fees are based on hourly estimates, no separate "overtime" charges will arise unless an extension occurs.


Article 7 (Disclaimer Regarding Facility Equipment)

The Facility is not currently equipped with flush toilets. Facilities equivalent in specification to disaster-relief toilets are provided; users shall use the Facility after confirming and accepting this.


Article 8 (Cancellation Policy)

For cancellations at the user's convenience after a reservation is confirmed, cancellation fees apply as follows. "Business days" means the Company's business days excluding weekends and public holidays.

(1) Cancellation up to 5 business days prior: no charge

(2) Cancellation 4 business days prior: 30% of the estimate

(3) Cancellation 3 business days prior: 50% of the estimate

(4) Cancellation 2 business days prior: 80% of the estimate

(5) Cancellation the day before or the day of use: 100% of the estimate


Article 9 (Application Mutatis Mutandis)

Matters not stipulated in these Terms (intellectual property rights, prohibited acts, termination, no warranty/disclaimer, damages, exclusion of antisocial forces, governing law, jurisdiction, etc.) shall be governed mutatis mutandis by the provisions of the Company's separately established "Terms of Service."

(hereinafter referred to as "our company") has established the following privacy policy (hereinafter referred to as "this policy") regarding the handling of personal information of those who use our company's services (hereinafter referred to as "users"), and has promoted the protection of personal information by building a system for protecting personal information, making all employees aware of the importance of protecting personal information, and thoroughly implementing such measures.

  10. To identify users who have violated the terms of use or who are attempting to use the service for fraudulent or improper purposes, and to refuse such use

 

Article 3 (Use of Cookies, etc.)

  1. The Company may use cookies and other information gathering modules (hereinafter referred to as "Cookies") to obtain information on users' access to the Service, browsing information, etc., for the purpose of analyzing access to the Service. Please note that this information obtained through cookies (hereinafter referred to as "Cookie Information") does not include information that can identify or specify the user on its own.

  2. Users can set the use of cookies, etc. on this service. If users do not permit the use of cookies, etc., they can disable cookies, etc. in their browser settings, etc. However, disabling cookies, etc. may reduce the convenience of this service or limit the scope of use of the services provided by this service.

  3. We will use cookie information for the purpose of operating, maintaining and improving the quality of our Service, as well as for the development and improvement of our products and services, and for delivering advertisements tailored to users' usage of our Service.

 

Article 4 (Management and protection of personal information)

Article 5 (Entrustment of Personal Information Handling)

We may outsource all or part of the handling of personal information to a third party within the scope necessary to achieve the purpose of use. In such cases, we will thoroughly examine the suitability of the third party, stipulate matters related to confidentiality obligations in the contract, and provide necessary and appropriate supervision of the third party.

A user or a user's representative may, in accordance with the procedures specified by our company, request notification of the purpose of use of retained personal data that identifies the user, disclosure of retained personal data or records of provision to a third party, correction, addition, or deletion of the contents of retained personal data, and suspension of use, erasure, or suspension of provision to a third party of retained personal data. Article 7 (Procedure for changing the privacy policy)

Cancellation Policy

Due to the nature of the product, cancellation is not possible. In addition, refunds and pro rata calculations will not be made for cancellations midway through the contract.

Response in case of non-compliance with contract

1. If you are unable to view or download the product, we will investigate and take appropriate action. If the product defect is not resolved or if the product is found to be non-compliant with the contract, we will cancel your payment within 10 days of the purchase date. Please note that any costs incurred in this case (communication costs) will be borne by the customer.

2. In the event of a malfunction specific to the customer's environment, we shall have no obligation to provide support.
